Please read the following terms and conditions carefully as use of and/or buying from Dizzy Cherry online means that you will be bound by them. In certain instances these terms incorporate statements to be found in the Privacy Policy, Delivery and Returns sections of our site.

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period.

 
PURCHASE OF PRODUCTS
 
When you place an order on our website we shall email you an acknowledgement. Our acceptance of an order does not take place until dispatch of the order, at which point the purchase contract will be made and you will be charged.
 
Only persons over eighteen years of age with a residential address in the UK can place an order.

 If for any reason we are unable to fulfil your order, we will let you know at the earliest opportunity. If payment for an order is processed and if we have already accepted payment for the order, this will be refunded to your account or the card with which you made payment.
 
Disclaimer

Every effort has been made to ensure that the colour of products are displayed accurately on our website.  However we cannot guarantee that the colours you see on your monitor will reflect the colour of the product on delivery, as this is dependent upon your monitor colour settings.
 
All sizes and measurements are approximate.

All Goods are subject to availability.  As there is a delay between the time when the order is placed and the time when the order is accepted, the stock position relating to particular items may change. If an item you have ordered becomes out of stock before we accept the order we shall notify you as soon as possible and you will not be charged for the out of stock items.

Any delivery estimates given on this Website or by email are estimates only.

Dizzy Cherry will not be responsible for the performance of any obligations under these terms and conditions in the case of an event outside of our reasonable control (force majeure), including (but not limited to) strikes, lockouts, failures of third party systems or networks, acts of god, fire, earthquake, storm, flood or other natural disaster, civil unrest, acts of terrorism, deliberate sabotage of or malicious damage to equipment or data or for damage to or destruction of premises or equipment.

Dizzy Cherry's Privacy Policy which explains how we will use your information can be found at Privacy Policy.  By using this Website, you consent to the processing described therein and warrant that all data provided by you is accurate.

Misuse of this website is strictly prohibited.  You will not: commit or encourage a criminal offence; transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as "spam"; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offence under the Computer Misuse Act 1990. Dizzy Cherry will report any such breach to the relevant law enforcement authorities and disclose your identity to them.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.
Promotional Codes
All promotional codes remain the property of Dizzy Cherry, are non-transferable and may not be reproduced in any form or used in conjunction with any other offer.
Only one promotional code per transaction may be used.

Free Delivery Offers
Free delivery offers are subject to availability and are NOT applicable to addresses outside mainland UK.  
 
Cancellation and Returns
Under the Distance Selling Regulations you have a "cooling off" period of seven working days (beginning the day after confirmation of your order) to cancel your order and receive a full refund, including delivery costs.

 
If you wish to cancel your order, and where the order has not been dispatched, you may notify us by email atcustomerservices@dizzycherry.com.
 
Where goods have been dispatched you may return them within 14 days of receipt for a full refund and/or exchange.  The costs of returning the goods to Dizzy Cherry shall be borne by you.
 
A full refund or exchange will be issued upon receipt of the goods.
 
Postage and packaging charges are only refunded if all items in the order are returned.
 
Refunds will be credited to your original method of payment.

 Prices are subject to change without notice. Prices are inclusive of VAT (where applicable).
 
In the interests of hygiene we do not offer refunds or exchanges on pierced jewellery, unless they are of unsatisfactory quality or unfit for purpose.  Please also note that items must be returned in their original packaging and with all of the barcode tags intact.
